2. Scope of Application
These Terms and Conditions ("Terms") govern all purchases, use, and access of products and services offered by Van Eck Ventures Ltd., trading as SYNK, including both physical products (notebooks, printed decision pages) and digital products (software applications, templates).
By placing an order or accessing SYNK products, the customer agrees to be bound by these Terms. For business customers (B2B), these Terms apply unless a separate written agreement supersedes them.
Important: Use of digital products is at the customer’s own risk. SYNK products are intended for organizational and professional support only and do not constitute legal, financial, or medical advice.
3. Ordering and Acceptance of Orders
Orders can be placed via the SYNK website or authorized sales channels.
SYNK reserves the right to accept or reject any order at its discretion, including orders with fraudulent payment or insufficient stock.
An order is considered accepted once SYNK confirms shipment (for physical products) or delivery (for digital products).
Digital product delivery occurs immediately upon download or email confirmation unless otherwise specified.
Product availability is not guaranteed and may be subject to stock limitations or unforeseen circumstances.
4. Product Information and Pricing
SYNK strives to ensure that all product descriptions, specifications, and images are accurate. Minor variations in color, dimensions, or design may occur and do not constitute a defect.
Pricing is displayed in Euros (€) and includes applicable VAT unless stated otherwise.
Prices are subject to change without prior notice. Confirmed orders are billed at the price displayed at the time of purchase.
5. Payment Terms
Payments must be completed at the time of order. Accepted methods include major credit/debit cards, PayPal, and bank transfers where specified.
All transactions are secure and encrypted.
Failure to complete payment may result in order cancellation.
SYNK reserves the right to suspend or cancel orders in case of suspected fraudulent activity.
6. Shipping and Delivery
Physical products are shipped to addresses within the European Union within 2–5 business days from order confirmation.
Delivery times are indicative. SYNK is not liable for delays caused by carriers, customs, or other events beyond its reasonable control.
Customers are responsible for providing accurate shipping information.
Risk of loss transfers to the customer upon delivery to the carrier.
7. Returns, Cancellations, and Refunds
Physical Products:
SYNK offers a 100-day return policy for all physical products, provided they are in resalable condition.
Products that are damaged, misused, or altered by the customer are not eligible for return.

Return shipping costs are the responsibility of the customer, unless the product is defective.
Digital Products:
Due to the nature of digital content, all sales are final once delivered.
Refunds are only provided in cases of technical defects confirmed by SYNK.
Cancellations:
Orders may be canceled prior to shipment by contacting support@synk.com.
8. Warranty and Liability
SYNK warrants that physical products are free from manufacturing defects at the time of delivery.
Warranty claims must be submitted within 12 months of delivery.
SYNK is not liable for indirect, incidental, consequential, or special damages, including lost profits, data loss, or business interruption.
Maximum liability is limited to the purchase price of the product.
This limitation applies to all claims, whether based on contract, tort, negligence, or other legal theory, including but not limited to digital product delivery, data loss, software incompatibility, or service downtime.
9. Digital Product License
SYNK grants the customer a limited, non-exclusive, non-transferable license to use digital products solely for personal or internal business purposes.
Reproduction, resale, distribution, or public display of digital products without prior written consent is strictly prohibited.
10. Indemnification
The customer agrees to indemnify, defend, and hold SYNK, its officers, directors, employees, and affiliates harmless from any claims, damages, losses, or expenses arising from the customer’s misuse of SYNK products or violation of these Terms.
11. Intellectual Property
All SYNK products, designs, software, templates, and content are protected under copyright, trademark, and other intellectual property laws.
Customers may not reproduce, distribute, modify, or resell SYNK content without prior written consent.
The SYNK logo and brand elements are exclusive property of Van Eck Ventures Ltd.
12. Privacy and Data Protection
SYNK processes personal data in accordance with the EU General Data Protection Regulation (GDPR).
Personal data is used solely for order processing, customer support, and improving the customer experience.
Data may be shared with service providers strictly for order fulfillment or payment processing.
Customers have the right to access, correct, or request deletion of their data by contacting support@synk.com.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in the registered office jurisdiction.
For international customers, mandatory consumer protection laws of the applicable jurisdiction may still apply.
14. Force Majeure
SYNK is not liable for failure to perform obligations due to events beyond its reasonable control, including but not limited to: natural disasters, strikes, technical outages, server failures, or governmental restrictions.
15. Amendments to Terms
SYNK reserves the right to update or amend these Terms at any time.
Customers will be notified of material changes via email or website announcement.
Continued use of SYNK products constitutes acceptance of the updated Terms.
16. Disclaimers
SYNK products are intended for organizational, professional, and decision-making support.
They do not constitute legal, financial, or medical advice.
SYNK does not guarantee uninterrupted access to digital services or compatibility with all devices or software updates unless explicitly stated.
17. EU Consumer Rights
Nothing in these Terms shall limit or exclude the statutory rights of consumers under applicable EU law.
18. Digital Delivery Disclaimer
Upon delivery, the customer is solely responsible for maintaining backup copies of all digital products. SYNK is not responsible for loss, corruption, or accidental deletion of digital content.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
